JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-10-2017 The petitioner seeks regular bail in connection with Daraundha P.S. Case No. 18 of 2017, registered for offences punishable under Sections 302/34 of Indian Penal Code. Allegation against the petitioner and other accused persons is of firing on the deceased, resulting his death. It has been submitted on behalf of the petitioner that the allegation is in three parts. In first part, there is allegation that petitioner and one co-accused Amarjit Singh fired on the deceased, in second part two other accused persons fired on the deceased while he was fleeing away and third part there is allegation against other two accused that they fired on the deceased due to which he died and, therefore, it clearly appears that there is nothing specific whose bullet caused the death of the

Heard learned A.P.P. also.

Having heard both sides, considering the fact and circumstances of the case and also the fact that there is direct allegation against the petitioner that he along with others fired on the deceased resulting his death, as such, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.

However, after substantial progress in trial, he may renew his prayer for bail.
