2. The petitioner apprehends his arrest in a complaint case punishable for the offence under Sections 323, 504, 506, 379 and 420 of the Indian Penal Code.

3. It is alleged that this petitioner deliberately, in order to grab the money of the complainant, executed the sale-deed in favour of the complainant, but did not allow him to make construction on the said land and also committed Maarpeet with him. It is further alleged that accused-petitioner removed the boundary wall of the complainant and also committed theft of bricks worth Rs. 10,000/-.

4. Learned counsel for the petitioner submits that from the complaint petition, it is apparent that the land in question has already been sold by petitioner in favour of complainant in the year 2021. As a matter of fact, there is dispute between the parties over pathway. Rest of the allegation is ornamental in nature. Moreover, the dispute is purely of civil nature.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-cum-Sub Judge-I, Bikramganj, District - Rohtas in connection with Complaint Case No. 260 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
