2. The petitioner seeks bail in connection with Samastipur Rail P.S. Case No. 272 of 2024 registered for the offence under Section 305(c) of the BNS, 2023.

3. As per the prosecution case, the petitioner is accused of committing theft and some of the stolen articles have been recovered from his possession.

4. The petitioner is in custody since 16.12.2024 and he claims to have clean antecedent.

5. Considering the aforesaid facts, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Railway,

Patna High Court CR. MISC. No.18178 of 2025(4) dt.12-05-2025 2/2 Samastipur/concerned Court in connection with Samastipur Rail P.S. Case No. 272 of 2024, subject to the condition that the bailors should be the close relative of the petitioner.

7. As a condition of this order, the petitioner after being released on bail is directed to mark his attendance at Maheshkunth Police Station on every Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner.

8. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.

9. As the petitioner claims to have clean antecedent, the Court below, before accepting the bail bonds of the petitioner is directed to verify the antecedent of the petitioner. If the petitioner is found to be involved in any other case then the bail bonds of the petitioner shall not be accepted. (Sandeep Kumar, J) Vikas/- U
