This is an application for bail in connection with Kasim Bazar P.S.Case No. 84 of 2017 registered for the offences punishable under Sections 25(1-A), 25(1-AA), 25(1-B)(a), 26(i)(ii)(iii) and 35 of the Arms Act.

Allegation against the petitioner is of manufacturing arms and it appears from the seizure list that half prepared pistols and other articles were recovered from the house of the petitioner. Submission of learned counsel for the petitioner is that there is no independent witness to the occurrence and further he is in custody for six months having no criminal antecedent. Heard learned APP also, who has opposed the prayer for bail.

Patna High Court Cr.Misc. No.44384 of 2017 (3) dt.10-10-2017 2/2 Having heard both sides and in the facts and circumstances of the case, I am not inclined to grant bail to the petitioner at this stage.

However, learned trial court is directed to expedite the trial and try to conclude it within a period of six months. At the same time, Superintendent of Police, Munger is directed to ensure the presence of the witnesses in court so that the trial be concluded within the specified period.
