The petitioner apprehends his arrest in a case registered for the offence under Sections 147, 341, 323, 324, 379, 427, 504, 34 of the Indian Penal Code.

As per F.I.R., petitioner is alleged to have given sword blow on the head of Vishwanath Sah causing cut injury and he is also alleged to have opened firing from illegal fire-arms four rounds.

It is submitted on behalf of petitioner that the injury caused by the petitioner is simple in nature. Though, there is allegation of firing, but no one sustained any fire-arm injury. Petitioner has got clean antecedent.

Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

No.16560 of 2022(2) dt.27-09-2022 2/2 Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 8th Additional Chief Judicial Magistrate, East Champaran at Motihari in connection with Patahi P.S. Case No. 91 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
