The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Section 363 and additional Sections 366, 366A of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that his minor daughter aged about 15 years had accompanied her mother to the market from where she went missing. It is alleged that based on suspicion, the petitioner came to be implicated as he used to talk to the victim and thus, might have enticed her away. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case. It is next submitted that victim is not a minor and she was married from before. It is also submitted that this petitioner and the victim were

Patna High Court CR. MISC. No.16377 of 2023(2) dt.25-05-2023 2/2 known to each other. The learned counsel further submits that the victim has returned on her own and she is staying with her parents. It is further submitted that petitioner will not abscond rather will cooperate in the investigation and will present himself as and when required by the Investigating Officer for inquiry. Learned A.P.P. opposes the bail application.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bailbonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Praveen Kumar, the learned J. M., First Class, Patna in connection with Beur P. S. Case No.547 of 2021, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
