In this application for anticipatory bail the petitioner apprehends his arrest in a case punishable for the offence under section 379 of the I.P.C.

Allegedly the petitioner being tenant took away the A.T.M. Card of the informant and withdrew the amount of Rs. 40,000/- from his account.

Submission is of false implication and that only on suspicion the petitioner has been implicated only with a view to get the premises vacated.

The learned A.P.P. also fairly submits that wife of the informant has not seen the petitioner in committing the theft of A.T.M.

No.30492 of 2014 (2) dt.21-01-2015 2/2 Under the facts and circumstances as stated above, the petitioner in case of his arrest or surrender within two months from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Madhubani in Rajnagar P.S. Case No. 14 of 2011, subject to the conditions as laid down in section 438 (2) Cr.P.C.
