In this case, the petitioner is seeking regular bail in connection with Bochahan P.S. Case No. 149 of 2019 registered for offence punishable under section 302 of the Indian Penal Code.

An U.D. case no. 1 of 2018 was lodged and later on, the same was converted into Bochahan P.S. Case No. 149 of 2019 registered for offence punishable under section 302 of the Indian Penal Code.

The victim, who happens to be niece (Bhagni) of the petitioner, was found dead due to strangulation. In the present case, the petitioner has stated about the three criminal cases in this application but when the informant

Patna High Court CR. MISC. No.13973 of 2020(9) dt.22-01-2021 2/2 has appeared, he has disputed the correctness of the statement and filed a counter affidavit in which he has mentioned that ten cases are pending against the petitioner. The petitioner has filed the reply to the counter affidavit and has not disputed about the pendency of those cases.

Looking to the facts and circumstances of the case, this Court does not find any merit in the present case and the same is dismissed with cost of Rs.5,000/- to be deposited by the petitioner in the Patna High Court Legal Services Committee within four weeks.
