This is an application for bail in connection with Warsaliganj P.S. Case No. 71 of 2016 registered for the offences punishable under Section 392 of the Indian Penal Code. Petitioner is not named in the FIR and later on his name transpires during course of investigation.

Submission of learned counsel for the petitioner is that he has been made accused in this case after nine months of occurrence and he is in custody since 15.2.2017. Further submission is that though he is accused in seven other cases but there is no material against him in this case. Heard learned APP also.

Having heard both sides and in view of fact that no doubt he has been made accused in seven other cases but he has been

No.45110 of 2017 (2) dt.22-09-2017 2/2 made accused in this case after nine months of occurrence, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-II, Nawada, in connection with Warsaliganj P.S. Case No. 71 of 2016, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioner will mark his attendance before local police station in first week of every month till conclusion of trial, so that police may watch his conduct during pendency of trial, failing which his bail bond shall be cancelled.
