JUSTICE SANJAY PRIYA ORAL ORDER 08-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Mahishi P.S. Case No. 124 of 2006 corresponding to Sessions Trial No. 121 of 2016 instituted for the offence under Section-307 & other minor Sections of the Indian Penal Code and 27 of the Arms Act.

It is alleged in the written report that the petitioner with other co-accused opened indiscriminate firing on the police force. The police also fired.

From the written report itself, it appears that there is no injury to anyone.

It has been submitted that co-accused with similar allegation has already been granted bail by a coordinate bench of this court vide order dated 04-07-2017 passed in Cr. Misc. No. 28276 of 2017. In paragraph-3 of the petition, it has been mentioned that the

Patna High Court Cr.Misc. No.37394 of 2017 (2) dt.08-08-2017 petitioner has no criminal antecedent.

In such circumstances, prayer for bail is allowed. The petitioner named above is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Mahishi P.S. Case No. 124 of 2006 corresponding to Sessions Trial No. 121 of 2016 to the satisfaction of learned Assistant Sessions Judge-II-cum-CJM, Saharsa subject to condition that both the bailors should be close relative of the petitioner.
