The petitioner apprehends his arrest in a case registered for the offence under Sections 25(1-b)a, 26 & 35 of the Arms Act, Section 3/5 of Explosive Substances Act and Sections 452, 386, 387 and 120(B) of the Indian Penal Code. Altercation took place between the inmates of the hostel of L.S. College.

It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case. Neither any arms or ammunition has been recovered from the possession of this petitioner nor petitioner was present in the alleged hostel. At the relevant time, petitioner was under-treatment in Sadar Hospital, Muzaffarpur from 14.12.2017 to 17.12.2017 and in support of the same, he has annexed Discharge Ticket, which is kept as Annexure - 2 to this petition. Some of the co-accused persons have already been granted bail by this Court.

Patna High Court CR. MISC. No.16413 of 2022(2) dt.27-09-2022 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - VIII, Muzaffarpur in connection with University P.S. Case No. 32 of 2017 (G.R. No. 5901 of 2017), subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
