JUSTICE MOHIT KUMAR SHAH ORAL ORDER 04-04-2024 The present writ petition has been filed seeking the following relief:- "1(i). Issuance of writ or writs in the nature of Mandamus directing the Respondents to consider the Representations (Annexure - P/4 Series, P/7 and P/9 Series) of the Petitioner and take appropriate legal action for appointment of Petitioner as Sanitation Supervisor in the Gram Panchayat Kukurdaura, Block Laukahi, District Madhubani as the Petitioner is the most eligible/suitable candidate for the said post as per

Patna High Court CWJC No.4335 of 2024(2) dt.04-04-2024 2/3 Department direction/Guidelines.

(ii). Issuance of writ or writs in the nature of Mandamus directing the Respondents to follow the directions given by the Block Development Officer-Cum-Chairman, Block Sanitation Officer, Laukahi, Madhubani vide Letter No. 2201 dt. 11.09.2023 (Annexure-P/8) by which it was specifically directed to cancel the illegal appointment and to take fresh steps for conducting Gram Sabha for fresh appoint of Sanitation Supervisor as per law.

(iii). Issuance of writ or writs in the nature of Mandamus directing the Respondents to conduct fresh Gram Sabha and further to make fresh appointment in the light of Departmental directions and guidelines.

(iv). Issuance of writ or writs in the nature of Mandamus directing the Respondents to conduct an enquiry against those persons who has done the illegal appointment on the post of Sanitation Supervisor Gram Panchayat - Kukurdaura, Block - Laukahi, Madhubani and punish the persons responsible for the said illegal appointment." 2.

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to approach the Respondents authorities for redressal of his aforesaid
