That, this writ petition is for issuance of an appropriate writ/ writs in nature of

Patna High Court CWJC No.4343 of 2024(2) dt.16-05-2024 2/3 MANDAMUS for commanding and directing concerned authorities under District Administration especially the District Magistrate, Samastipur and Superintendent of Police equally to provide protection to his life, liberty and personal property, which are constitutional rights guaranteed under Article 21 and Article 300A of the Constitution of India considering the rights and entitlement upon the land in terms of the declaration of entitlement by the authority under section 106 of B.T. Act in different Cases, rent receipts against respective lands and additionally the Order passed by SubDivisional Officer, Roshra on 13.07.2023 in M.R. No. 196//2023 which attains its finality. However, the Private Respondent has captured/encroached upon piece of land with the help of unsocial elements or on point of muscle, man power and money ignoring all those order on point of possession upon the land in question, whereas, such exercises are against established principle of law."

After some arguments, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the respondentauthorities for redressal of his aforesaid

Patna High Court CWJC No.4343 of 2024(2) dt.16-05-2024 3/3 grievances. Liberty, so sought, is granted.

Accordingly, the writ petition stands disposed of.
