The petitioner, who is apprehending his arrest in a case registered for the offence punishable under Section 380 of the Indian Penal Code, is one of the named accused in this case of year 2010 with allegation of making way in the wall of godown of the informant and taking away some articles therein. The informant was intimated by a tenant Manju Devi, who during investigation also supported the allegation leveled against the petitioner and the place of occurrence also indicates the wrong done. Submission is of false implication due to business rivalry between the parties.
Having regard to the facts and circumstances of the case, the petitioner appears not entitled for the privilege sought. Hence, the prayer for anticipatory bail of the abovenamed petitioner, in connection with Gaya Kotwali P.S. Case No. 257 of 2010, pending in the court of learned Chief Judicial Magistrate, Gaya, is hereby refused. (Akhilesh Chandra, J) Praveen-II/-
