JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 09-01-2015 Heard learned counsel for the petitioners and learned counsel representing the State.

The petitioners apprehending their arrest in connection with Roushanganj (Banke Bazar) P.S. Case No. 18 of 1999 registered for the offence under Sections 147, 148, 149, 302 of the Indian Penal Code and Section 27 of the Arms Act seek privilege of pre arrest bail.

At the very outset, it is submitted that in this case finding no clue Final Form was submitted, but the Magistrate after differing with the view took cognizance and as such the petitioners being law abiding citizens deserve sympathetic consideration to which the learned APP does not dispute. In the facts and circumstances as stated above, in

Patna High Court Cr.Misc. No.29533 of 2014 (2) dt.09-01-2015 case of arrest or surrender before the court below within two months from the date of receipt/production of a copy of this order, the petitioners namely Sri Yadav, Dinesh Yadav and Munshi Yadav shall be released on bail on execution of bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Sherghati (Gaya) in connection with Roushanganj (Banke Bazar) P.S. Case No. 18 of 1999, G.R. No. 230 of 1999 with condition as laid down under Section 438(2) Cr.P.C.
