That the present writ petition is for issuance of an appropriate writ/ writs in nature of MANDAMUS for commanding and directing concern authorities for holding fair and impartial enquiry in terms of representation dated 20.06.2023 presented before Circle Officer, Barh and a copy of same was forwarded to superior authorities for determination/ decision regarding construction of shade in Khata No. 255, Khesra

Patna High Court CWJC No.3932 of 2024(2) dt.16-05-2024 2/2 No. 597 creating obstacle whereas, the shade is already available upon the land in question and the further prayer is for setting aside the order of Sub- Divisional Officer, Barh in Memo No. 261 dated 24.01.2024 whereby and whereunder the finding recorded for construction of shade without proper appreciation and consideration of materials available therein."

At the outset, the learned counsel for the petitioners seeks liberty on behalf of the petitioners to challenge the aforesaid order dated 24.1.2024, passed by the Sub-Divisional Officer, Barh, by filing appropriate appeal. Liberty, so sought, is granted. 3.
