Mr.Shahabuddin Azeem @ S. Azeem ====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SINGH CHANDEL ORAL ORDER 15-05-2025 Heard learned counsel for the petitioner as well as the counsel appearing for the respondent-State.

2. This is the first regular bail application submitted by the petitioner who has been arrested in connection with Ramnagar P.S. Case No. 554 of 2024 dated 01.12.2024 for the alleged offences punishable under Sections 20(b)(ii)(B), 22(c), 23(b) of NDPS Act.

3. According to the case of prosecution, it is alleged that on 01.12.2024 on the basis of information received from the informant the police officials searched and seized total 7 kg 600 grams of contraband ganja from the possession of the present applicant.

4. It is submitted by the counsel for the petitioner that the petitioner herein is innocent and is falsely implicated in this case. He further submits that the petitioner is in custody since 01.12.2024, quantity of the seized contraband is not commercial and there is no

Patna High Court CR. MISC. No.16314 of 2025(3) dt.15-05-2025 2/2 previous antecedent of the petitioner. Therefore, on these grounds, he may be entitled to get the benefit of bail.

5. Learned counsel appearing on behalf of respondentState opposes the prayer of bail.

Considering the submission made by the counsels and particularly considering the quantity of the seized contraband item and further considering the detention period, I am of the view that in this case the present applicant should be granted the benefit of bail. Accordingly, the petition is allowed. The petitioner is directed to be released on bail in connection with Ramnagar P.S. Case No. 554 of 2024 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties, to the like amount each to the satisfaction of the learned Exclusive Special Judge, NDPS, West Champaran at Bettiah.
