Petitioner seeks bail in Chanpatiya P.S. Case No.452 of 2018 instituted for the offence under Section(s) 302, 201, 404/34 Indian Penal Code.

Petitioner is not named in the First Information Report.

It is alleged that in the written report that son of the informant had gone by tractor for loading of sand. It is alleged that son of the informant informed him that he is going to unload the sand to his one acquainted person, Rajesh Ram, but he did not return. It is also alleged in the written report that one tractor driver told the informant that his son was seen with Rajesh Ram at Jogia Tola Chowk. Thereafter, the informant

Patna High Court CR. MISC. No.15732 of 2019(3) dt.29-05-2019 2/2 went to the house of Rajesh Ram and asked about his son, but he did give any reply. Later on, he told that his friends, Rajeshwar Ram and Mithun called his son for purchasing of sand at Bhachaha Pool under criminal conspiracy where they were present from before. Thereafter, they have committed murder of his son and thrown the dead body in canal. Name of the petitioner has come during investigation only on the basis of the call details that accused Rajesh Ram had called the petitioner on 30.10.2018 in morning. The police arrested the petitioner and recorded his confessional statement. Petitioner is in custody since 25.11.2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, V, Bettiah, West Champaran, in connection with Chanpatiya P.S.
