JUSTICE ANIL KUMAR SINHA ORAL ORDER 02-06-2020 Heard Mr. Rudra Deo, learned counsel for the petitioners and Mr. Nawal Kishore Prasad, learned counsel appearing for the State through video conferencing. Petitioners seek regular bail in connection with Noorsarai P.S. Case No. 327 of 2019 registered for the offence punishable under Section 147, 148, 149, 341, 323, 307, 302, 504 of the Indian Penal Code, 1860.

The allegation against the petitioners as per the First Information Report is that the petitioners along with other accused persons, total nine in number, assaulted the father of the informant causing injuries, leading to his death. Learned counsel for the petitioners submits that petitioner no. 2 is a 50 years old lady and petitioner no. 1 is his

Patna High Court CR. MISC. No.13851 of 2020(3) dt.02-06-2020 2/3 son, aged about 19 years. Learned counsel further submits that both the parties are agnates and there is land dispute between them. Learned counsel further submits that similarly situated accused persons namely, Smriti Lata Devi and Sushila Devi have been granted bail by this court in Cr. Misc. No. 956 of 2020. Learned counsel also submits that charge sheet has already been submitted in this case and the petitioners are in custody since 04.11.2019.

Having regard to the submissions made by the parties and taking into consideration the fact that petitioner no. 2 is a lady and petitioner no. 1 is his son, aged about 19 years; there is no specific allegation against them, charge sheet in this case has already been submitted and similarly situated accused persons have been granted bail by this court, I am inclined to grant regular bail to the petitioners.

Accordingly, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Noorsarai P.S. Case No. 327 of 2019.

It is made clear that at the time of furnishing bail
