Petitioner apprehends arrest in connection with Goreyakothi P.S. Case No.217 of 2017 registered for the offence punishable under Sections 30 (1), 41 (1) of Bihar Prohibition and Excise Act, 2016.

Learned counsel appearing for the petitioner submits that the alleged recovery has been made from a truck which does not belong to this petitioner. Petitioner has no concern with the recovered liquor. Further petitioner has been implicated in this case on the basis of confessional statement of co-accused. Petitioner is a man of clean antecedent.

Considering the facts and circumstances of the case

Patna High Court Cr.Misc. No.32693 of 2018 (2) dt.05-06-2018 2/2 and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge cum Special Judge, Siwan in connection with Goreyakothi P.S. Case No.217 of 2017 subject to the conditions laid down under Section 438(2) Cr.P.C. (Arvind Srivastava, J) N.H./- U T
