2. This application, for grant of anticipatory bail, arises out of Sheikhopur Sarai Police Station Case No. 142 of 2024, disclosing offences under Sections 126(2), 115(2), 117(2), 109, 303(2), 352, 3(5) of the B.N.S.
3. The prosecution case, as per the First Information Report, is that on 08.11.2024, in the morning, while the informant was returning back from the Ghat after completion of Chhath Puja, there was some verbal duel between the informant and petitioner no.1, namely, Bipin Chaudhary. Thereafter

After sometime the petitioners along with other accused persons arrived at the house of the informant, assaulted informant's father, namely, Gandhi Chaudhari, mother and other family members by means of lathi, danda and iron rod. It has been alleged that accused person also snatched golden chain.
4. Learned Counsel for the petitioners submits that both the parties are agnates which would be evident from the counter case lodged by the wife of petitioner no. 1 bearing Shekhopur Sarai P.S. Case No. 143 of 2024 dated 08.11.2024 for an occurrence which has taken place on the same date. He further submits that injury sustained by the victims are simple in nature and the injury caused to the informant's father is reserved. However, informant's father has sustained pain in the left leg and head which does not appear to be serious in nature.
5. Regards being had to the submissions made by the parties and taking into consideration the fact that both the parties are agnates, case and counter case is there and the injury sustained by the victims are simple in nature, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his

No.15110 of 2025(2) dt.08-04-2025 3/3 arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura, in connection with Shekhopur Sarai Police Station Case No. 142 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
