The petitioners are apprehending arrest in a case registered for the offences registered under sections 147, 149, 148, 447, 325, 326, 307, 427, 379 , 504 of the Indian Penal Code and section 27(2) of the Arms Act.
It is alleged that the accused persons including the petitioners variously armed came and started abusing and damaging the house of the informant. It is further alleged that Achchchhelal Rai, Pintu Rai and Amarjeet Rai made firing indiscriminately, due to which informant received gun shot injury on his wrist and thumb. When the brother of the informant Rajeev came to save, accused Amarjeet and Pintu also assaulted him with
Patna High Court Cr.Misc. No.27235 of 2015 (2) dt.21-07-2015 2/2 sword on his head, whereas on the firing made by Manager Rai, the informant received injury on several parts of the body. The accused persons also snatched away Rs. 4800/- and golden ring from the informant.
It is submitted by the learned counsel for the petitioners that the accusation of assault of firming is not against the petitioners. There is a counter-version of the occurrence also. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Ganga Bridge P.S. Case No. 131 of 2014, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
