In this case, the petitioner is seeking regular bail in connection with Gaighat P.S. Case No. 417 of 2019 registered for offence punishable under section 302 read with section 34 of the Indian Penal Code.

Allegation has been made that the petitioner and other accused persons connived and killed the victim. From the case diary it appears that the husband of the petitioner is a victim used to assault her in a drunken condition. On the fateful day, the victim came and altercated with petitioner, her brother-in-law (bahnoi) and sister and whereafter

Patna High Court CR. MISC. No.15926 of 2020(4) dt.17-02-2021 2/2 five persons assaulted the victim and killed. Learned counsel for the petitioner submits that so far allegation against the petitioner, there is no specific allegation against her rather her husband used to assault her. He further submits that the petitioner is in custody since 06.12.2019. Looking to the period of custody, let the petitioner above named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of 15th Additional Chief Judicial Magistrate, Muzaffarpur in connection with Gaighat P.S. Case No. 417 of 2019, subject to the condition that one of the bailors of the petitioner shall be her close relative. The petitioner will not induce any witness or tamper with the evidence.

The petitioner shall cooperate in the disposal of trial and make herself available as and when required by the court. In case of failure on two consecutive dates without any valid reason, the court below will have liberty to take decision in accordance with law.
