JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 07-01-2015 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner apprehending his arrest in connection with Buxar (T) P.S. Case No. 231 of 2014 registered for the offence under Section 380 of the Indian Penal Code seeks privilege of pre arrest bail.

Allegedly, the petitioner committed theft of Lap Top charger and C.F.L. Bulb in the house of the informant as he along with other labourers and masson were doing work in the renovation of the house of the informant. Submission is that theft was committed allegedly on 05.05.2014 and detected on 10.05.2014 and the case has been lodged on 17.05.2014 after much delay only on suspicion.

Patna High Court Cr.Misc. No.28933 of 2014 (3) dt.07-01-2015 The petitioner has got no criminal antecedent and as such he deserves sympathetic consideration to which learned APP does not dispute.

In the facts and circumstances as stated above, in case of surrender or arrest before the court below within one month from the date of receipt/production of a copy of this order, the petitioner namely Dilip Kumar @ Jiut Kumar shall be released on bail on execution of bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar (T) P.S. Case No. 231 of 2014 with condition as laid down under Section 438(2) Cr.P.C. (Jitendra Mohan Sharma, J) P.K./- U T
