JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-08-2017 Petitioner No.2, Parmeshwar Manjhi, has been granted bail earlier by this Court vide order dated 14.7.2017. Heard learned counsel for the petitioners Nos. 1 and 3. This is an application for bail in connection with Rivilganj P.S. Case No. 99 of 2017 registered for the offences punishable under Sections 341, 323, 324, 307, 504 and 147 of the Indian Penal Code.
Allegation against petitioners Nos. 1 and 3 is that they have assaulted the injured Baliram Rai and Rajendra Yadav by rod on head.
Submission of learned counsel for the petitioners is that there is case and counter case between the parties and petitioner
Patna High Court Cr.Misc. No.26667 of 2017 (4) dt.25-08-2017 2/2 No.3 also received injuries during scuffle and petitioners are in custody for more than four months.
Heard learned APP also, who has opposed the prayer for bail stating that injuries are grievous in nature and, that too, on the head.
Having heard both sides and in view of allegation and nature of injury, I am not inclined to grant bail to the petitioners at this stage.
However, they may renew their prayer after framing of charge in this case.
