Mr. Sri Ahmad Ali ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 28-06-2018 Heard learned counsels for the petitioners and the State. The petitioners, already in custody, seek bail in connection with Suiya P.S.Case No. 13 of 2016 registered under Sections 397 and 397 of the Indian penal Code. Allegation in brief is that informant was robbed on the highway in the night by number of miscreants and was looted jewelries, Rs. 35,000/- cash and purse of the informant containing his driving licence and ATM cards of other relatives who were travelling in the same car.

Learned counsel for the petitioner submits that petitioner is not named in the FIR and merely on the basis of his confessional statement and recovery of Rs. 3000/- cash, which is his personal money, he has been implicated in this case and another co-accused Sonu Barnwal was admitted to bail by coordinate Bench of this vide Cr. Misc. No. 26396 of 2017.

No.34522 of 2018(2) dt.28-06-2018 2/2 Whereas learned counsel for the State submits that besides cash, driving licence of the informant looted in this case, was also recovered from the possession of the petitioner and he bears criminal antecedent of similar nature of two cases. Having considered the aforesaid facts and circumstances, the Court is not persuaded to grant bail to the petitioner, hence, prayer of bail is rejected.
