JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-04-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,406 and 504/34 of the Indian Penal Code and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.
The prosecution case is that the husband of the petitioner Rauf Ansari took some loan from the mother of the informant. It is alleged that on 5.12.2015 the informant went to the house of the petitioner to demand money from the husband of the petitioner when he was abused by calling caste name and assaulted.
It is submitted by the learned counsel for the petitioner that the thrust of accusation is against the husband of the petitioner
Patna High Court Cr.Misc. No.16823 of 2016 (2) dt.20-04-2016 2/2 but doubting the terms of loan agreement and the fact that the case diary does not contain the injury report the husband of the petitioner was granted regular bail by the learned court below. Considering the fact that the thrust of accusation is against the husband of the petitioner and petitioner is lady, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Sheohar in connection with Sheohar SC/ST P.S. Case No.34 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
