The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act.

As per the prosecution case, 250.185 litres of liquor was recovered from the vehicle parked in front of the house of the petitioner and the petitioner was taken into custody. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession. He has no concern either with the seized vehicle nor with the seized liquor. He is in custody since 31.1.2021 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts of the case especially the petitioner not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Samastipur Mufassil P.S. Case no.420 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 2nd -cum-Special Judge, Excise, Samastipur.
