The petitioners seek bail in Laxmipur P.S. Case No. 96 of 2017 instituted for the offence under Sections 341, 323, 324 and 504/34 of the Indian Penal Code.
It has been submitted that instant case has been lodged on account of land dispute. There is allegation against the petitioner No. 2 of assaulting the informant on neck with Tangi and in course of saving himself, he sustained injury on his back. The petitioner No. 1 is alleged to have assaulted cousin brother of the informant on head with Tangi. The injury report of both the injured have been annexed as Annexure-2 series which shows that doctor has found injuries on their person simple in nature. It
Patna High Court Cr.Misc. No.37380 of 2017 (2) dt.07-08-2017 2/2 has further been submitted that there was free fight. Kaushalya Devi has also filed a written report against the informant and nine others for assaulting Naresh Kora and his family members, before the police, but police did not register any case. Petitioners are said to be in custody since 26.5.2017. In such circumstances, prayer for bail of the petitioners is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Jamui, in connection with Laxamipur P.S. Case No. 96 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioners. (Sanjay Priya, J) S.Ali/- U T
