Learned Counsel for the petitioner submits that petitioner was not named in F.I.R. He was apprehended in this case only on suspicion. He has remained in custody since 24.04.2018 in connection Barsoi P.S. Case No. 272 of 2017 for the offence under section 30 (a) of the Bihar Prohibition & Excise Act, 2016.

Learned Counsel for the petitioner submits that from perusal of the FIR itself when name of the petitioner does not figure it would be apparent the petitioner was made accused only on suspicion as after thoughts.

Considering the fact that the name of the petitioner was not mentioned in the FIR and the fact he has remained in

Patna High Court Cr.Misc. No.32727 of 2018(2) dt.06-06-2018 2/2 custody for nearly one and half months, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II, cum special Judge (Excise), Katihar, in connection with Barsoi P.S. Case No. 272 of 2017.
