As per allegation, the informant after collection of money from Indoshil Finance Company was going to bank and when reached a few distance from Hakpara petrol pump, two persons riding on motor-cycle came there and made three round firings. The pillion rider pointed pistol towards temporal region of the informant and snatched his bag containing Rs. 3,30,480/- (Three lakhs thirty thousand and four hundred eighty) along with his Adhar Card, PAN Card, driving licence etc.

3. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in the present case. He was not arrested at the spot and nothing was recovered from his possession. He was arrested from hospital in injured condition.

4. On the one hand, learned Additional P.P. opposed the prayer for bail by submitting that perusal of paragraph-73 of the case diary shows that he was identified in CCTV footage. He also rendered his confessional statement in paragraph-118 of the case diary.

5. From perusal of paragraph-132 of the case diary, it appears that the petitioner is involved in two other cases whereas the petitioner in paragraph-3 of the petition, did not mention those cases. He has been identified in CCTV footage.

6. Considering the aforesaid facts and circumstances, the petitioner does not deserve the privilege of bail. Accordingly, prayer for bail in connection with Saharsa Sadar P.S. Case No. 829 of 2023 is rejected.

7. Learned Registrar General is directed to lodge Criminal Case for giving false affidavit against the erring persons.
