The petitioners apprehends their arrest in a case registered for offences punishable under Sections 304B, 120B/34 of the Indian Penal Code.
It is contended that petitioners are married sisterin-law (Nanad) of the deceased. It is further contended that the father-in-law of the deceased has already been taken in custody and husband of deceased has filed anticipatory bail application which is pending before the court below. It is urged that the petitioners are ladies, who were married prior to the date of occurrence and as such they do not have any role to play in
Patna High Court Cr.Misc. No.18203 of 2016 (2) dt.03-05-2016 2/2 demand of dowry etc. However, being family members omnibus allegations have been made against them.
Having regard to the facts and circumstances of the case and since the petitioners are married 'Nanad' of the deceased, let the petitioners, namely, Surmila Kumari @ Surmila Devi and Suman Kumari be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Jagdishpur P.S. Case No. 188/2003, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
