The petitioner prays for appropriate writ in the nature of mandamus commanding the respondent Municipal Commissioner, Patna Municipal Corporation to order for unilateral registration of Flat No. B-11, Bimla Tower, New Punaichak in the town and District- Patna inter alia on grounds that the developer of the agreement i.e. Managing Director of Architect and Engineering Private Ltd. has gone absconding and is traceless. Learned counsel for the petitioner invites the attention of this Court towards the application filed by the petitioner before the Municipal Commissioner on 18.3.2015 followed by reminders to submit that the same remains pending. Learned counsel has also invited the attention of this Court towards an order passed in
Patna High Court CWJC No.7544 of 2016 (2) dt.27-04-2016 2/2 C.W.J.C.No.14222 of 2013 by this Court in similar circumstances. Having heard learned counsel for the parties and considering the limited nature of grievance raised, I deem it fit and proper to dispose of the writ petition with the direction to the Municipal Commissioner, Patna Municipal Corporation, Patna to consider the grievance of the petitioner present at Annexure-8 and pass appropriate orders in accordance with law expeditiously and preferably within 3 months from the date of receipt/production of a copy of this order.
