The petitioner is in custody in connection with Spl. Case no. 3122/18 arising out of Danapur P.S. Case No. 174/18, for the offence under section 30(a) of Bihar Excise Prohibition Act, 2016.

Learned Counsel for the petitioner submits that petitioner has no criminal antecedent.

It appears that from the possession of the petitioner 1.5 liter of liquor was recovered and other recovery was not made from the conscious possession of the petitioner but from the outside of the boundary wall of the police line. Considering the fact that petitioner has no criminal antecedent and only 1.5 liters of liquor was recovered from the

Judge Excise, Patna, in connection with Spl. Case No. 3122 of 2018 arising out of Danapur P.S. case no. 174/18.
