Heard the learned counsel for the petitioner and learned APP for the State.
This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 30(a)/30)d)/41 of the Bihar Prohibition and Excise Act, 2016, registered in connection with Warisaliganj P.S.Case No. 422 of 2021.
As per allegation, 240 litres of country-made wine was recovered from near a pyne.
The learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.15941 of 2022(2) dt.26-05-2022 2/2 that he was not arrested at the spot. Nothing was recovered from his possession, although two cases are pending against him but in the present case there is nothing against him. He is in custody since 18.01.2022.
Considering the above facts and circumstances as well as the period of detention, let the petitioner above-named be released on bail after framing of charge on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No.2, Nawada in connection with Warisaliganj P.S.Case No. 422 of 2021.
If the court is vacant, the in-charge court shall frame the charge.
Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
