Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273, 420 of the Indian Penal Code and 47A of the Excise Act. The prosecution case is that 93.2 liters of illegal country made liquor were recovered from the hutment of the petitioner.
It is submitted by the learned counsel for the petitioner that hutment does not belong to the petitioner and hutment cannot be treated to be an closed place. Considering the nature of recovery, it is a case for consideration of prayer for regular bail, let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within
Patna High Court Cr.Misc. No.18137 of 2016 (2) dt.27-04-2016 a period of six weeks from today in connection with Barauli P.S. Case No. 250 of 2015, pending in the court of learned Chief Judicial Magistrate, Gopalganj.
