The petitioners have preferred this application for grant of regular bail in a case registered under sections 307, 447, 341, 323, 504, 506 and 34 of the Indian Penal Code and section 27 of the Arms Act.
As per the prosecution case, the five named accused persons are stated to have come variously armed. It is further stated that the petitioner no. 1 assaulted the uncle of the informant with an iron rod while the petitioner no. 2 assaulted the informant with a kudal causing injuries on their head. It is submitted by learned counsel for the petitioners that the allegations as levelled in the FIR are false and
Patna High Court CR. MISC. No.26638 of 2021(2) dt.29-11-2021 2/2 concocted. There is case and counter case between the parties, the correct versions having been stated in the counter case, FIR which has been brought on record as Annexure-2 to the petition. The injuries attributed to these two petitioners, the injury reports of which have been brought on record as annexure to the petition, it would transpire that the same are simple in nature. The petitioners are in custody since 19.1.2021 and the petitioner no. 1 has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the submissions made on behalf of the two petitioners and the petitioners having remained in custody for over 10 months, the petitioners are directed to be enlarged on bail in connection with Dumron P.S. Case no. 27 of 2021 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar.
