JUSTICE RAKESH KUMAR ORAL ORDER 08-11-2016 The petitioner, who is the husband of the complainant, has approached this court with a prayer to grant anticipatory bail. Earlier vide order dated 26.4.2016 while directing for issuance of notice to the complainant/ opposite party no. 2 a bench of this court had directed for taking no coercive steps against the petitioner.
Sri Arun Prasad Ambashtha, learned counsel appearing on behalf of the complainant /opposite party no. 2 submits that in the complaint petition there is specific allegation that without the consent of the complainant, who is legally wedded wife of the petitioner, the petitioner had solemnized second marriage. This
Patna High Court Cr.Misc. No.17692 of 2016 (4) dt.08-11-2016 2/2 fact has not been disputed.
In view of the nature of accusation, I do not find any ground to extend the privilege of anticipatory bail. The petition stands dismissed.
In view of dismissal of the petition, interim order of stay automatically stands vacated.
