The petitioner is accused in connection with Sessions Trial No. 267 of 2013 arising out of Chakai P.S. Case No. 192 of 2011 registered under Sections 376/34/504 of the I.P.C. pending in the Court of Additional Sessions Judge-III, Jamui. Submission is that petitioner is innocent and due to land dispute, he has falsely been implicated in this case. Further submission is that petitioner is in jail custody since 15.11.2016. Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that there is direct allegation of rape against the petitioner and on perusal of several paragraph of the case diary, it appears that witnesses have
Patna High Court Cr.Misc. No.36906 of 2017 (5) dt.21-12-2017 2/2 also supported the prosecution version. Hence, petitioner does not deserve bail.
Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected.
However, trial Court is directed to conclude the trial within a period of three months.
