The petitioner seeks bail in connection with Hajipur Town P.S. Case No. 245 of 2019, registered under Section 30(a) and 38 of the Bihar Prohibition and Excise Amendment Act.

The accusation is that in course of patrolling duty, the informant received information about doing of liquor trade by son-in-law of Late Lallu Singh along with Rajkumar Chaudhary (Petitioner) at Gandhi Chowk near Anjanpir Chowk in abundant house, the informant along with other Police personnel reached there and saw one person sitting on Apache motorcycle, who started to flee away leaving the

On search, 07 cartons, each containing 48 and 12 bottles of 180 ML, 02 cartons, each containing 24 bottles of 375 ML, 02 cartons, each containing 24 bottles of 375 ML, 02 cartons, each containing 24 bottles 375 ML and 11 bottles, each containing 750 ML Indian made foreign liquor recovered. Learned counsel for the petitioner submits that petitioner was not apprehended on the spot nor he is related in any manner to the family of co-accused Nageshwar Singh, son in law of Late Lallu Singh. Further submission is that, in fact, petitioner is accused in Hajipur Town P.S. Case No. 1154 of 2019 in similar nature of case due to that reasons, the petitioner has falsely been implicated in this case. The petitioner is in custody since 07.02.2020.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge-II-cum-Excise Court, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 245 of 2019.
