Petitioner is aggrieved by the order contained in Annexure-8. The District Magistrate after the order of this Court in C.W.J.C. No. 8081 of 2016 has considered the various aspects of the matter and on consideration of the report of SHO, Darauli and the fact that criminal case is pending against the petitioner he has passed order that on being acquitted by the competent court his case for revival of armed license may be considered.

On consideration of the discussion in the order dated 15.12.2017 when the District Magistrate has only decided not to lift the suspension on account of pending criminal case, the

Patna High Court CWJC No.7660 of 2019(2) dt.12-04-2019 2/2 Court does not find any infirmity in the order dated 15.12.2017 passed by the District Magistrate and as such the present application is dismissed. However, liberty shall be available to the petitioner in the event the petitioner is acquitted in the criminal case to approach the District Magistrate for restoration of the gun license.

With the aforesaid liberty, the writ application stands disposed of.
