The petitioner seeks regular bail in connection with Saharsa P.S.Case No.253 of 2017 registered for offences punishable under Sections 342, 363, 366(A), 379, 427 & 34 of the Indian Penal Code along with Section 3, 4, 5, 6 & of Immoral Traffic Act, 1956 and Section 12, 14, 16, 17 & 18 of POCSO Act. Allegation against the petitioner, as per F.I.R. is that the informant was enticed away by one co-accused, Firoz at Saharsa and confined her in a room. F.I.R. further shows that she met the petitioner and disclosed about flesh trade going on there. Submission of the learned counsel for the petitioner is that this petitioner had been informed about the fresh trade going on there and she helped the informant to escape from there; in
Patna High Court Cr.Misc. No.34510 of 2017 (2) dt.28-07-2017 2/2 spite of that she has been made accused in this case. The petitioner is in custody for about four months.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Ist Additional Sessions Judge-cumSpecial Judge at Saharsa in connection with Saharsa P.S.Case No.253 of 2017.
With following conditions :
(i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall co-operate in the disposal of trial and make herself available as and when required by the court and on the event of failure on her part to appear before the court below on two consecutive dates without showing any genuine reason, otherwise, her bail bond shall be cancelled.
With the aforesaid observation, this application is allowed. (Vinod Kumar Sinha, J) chn/- U T
