The petitioner seeks modification of the order dated 19.07.2017 passed in Cr. Misc. No. 27841 of 2017. Learned counsel for the petitioner submits that the present extension of time has been sought for the reasons that the petitioner was under the mistaken impression that since he has not been sent up for trial, it was not necessary for him to surrender and seek anticipatory bail. However, subsequently, the Magistrate has taken cognizance of the offence and the petitioner now stands under the same threat.

Considering the fact that the petitioner was earlier extended the benefit of pre-arrest bail and is also willing to file his documents presently, let the period for surrender fixed by order dated 19.07.2017 be extended to four weeks from today.

Patna High Court Cr.Misc. No.34712 of 2018 (2) dt.20-06-2018 2/2 The application for modification stands allowed to the aforesaid extent.
