The instant application for regular bail has been filed by the petitioner instituted for the offence punishable under Sections 365, 366/34 of the IPC.
As per allegation in the FIR, informant's sister went to college and did not return. During search, informant came to know that FIR named accused persons have kidnapped her for ill motive.
Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. Informant is habitual to implicate the innocent persons by lodging false cases with concocted story. He has got no criminal antecedent and
Patna High Court CR. MISC. No.17529 of 2023(3) dt.11-07-2023 2/2 languishing in judicial custody since 15.12.2022. Learned APP appearing for the State has opposed the prayer of bail and submitted that statement of the victim girl was recorded under Section 164 Cr.P.C., wherein she has made direct allegation of kidnapping and rape against the petitioner and others after intoxicating her by injection and pills. Medical report supports the prosecution story.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, I am not inclined to grant bail to the petitioner and, as such, his application for bail is rejected.
The trial court is directed to expedite and conclude the trial.
