The petitioners apprehend their arrest in G.O. Case No.185 of 2018 registered under Section 30(a) of the Bihar Prohibition and Excise Act.
The allegation as per prosecution report is that the excise official raided the house of Bhogendra Mandal and recovered huge quantity of liquor. Bhogendra Mandal is said to have disclosed the name of petitioners stating that the petitioners had given him liquor for selling. Having considered the facts that nothing has been recovered from possession of the petitioners and the names of petitioners surfaced in the case on so-called confessional
Patna High Court CR. MISC. No.15132 of 2019(2) dt.12-03-2019 2/2 disclosure of the accused from whose house huge quantity of liquor was recovered, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge II-cum-Special Judge (Excise Act), Madhubani in connection with G.O. Case No.185 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
