It appears from the record that the petitioner filed an application challenging legality, propriety and correctness of the order dated 21.12.2022 passed by learned Additional Sessions Judge-III, Banka in S.T. No.270 of 2022, whereby and whereunder the learned Additional Sessions Judge-III, Banka framed charge against the petitioner and other accused persons under Sections 308, 323, 341, 504/34 of the I.P.C. The petitioner has challenged the said order of framing of charge.

3. It is no longer res-integra that an order of framing of charge is not revisable. When charge is framed only courts open for the petitioner is to place his defence to prove that the charge so framed cannot be attracted against him.

4. Considering such aspect of the matter, this Court finds that the instant revision is not maintainable. Accordingly, the instant revision is dismissed.
