The petitioner is in custody since 27.10.2017 in connection with Kothi P.S. Case No. 52 of 2017 for the offence registered under Sections 25(1-b)a, 26 Arms Act of the Indian Penal Code.

Learned counsel for the petitioner submits that the alleged recovery was not made in the presence of independent witnesses and the entire case is concocted. It is further submitted that he has already in jail for more than 7 months and therefore, he may be extended the privilege of bail.

Considering the aforesaid facts and circumstances of the case and the submissions advanced by the petitioener, let the

Patna High Court Cr.Misc. No.33373 of 2018 (3) dt.06-07-2018 petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Gaya in connection with Kothi P.S. Case No. 52 of 2017.
