JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-05-2019 Petitioner seeks bail in anticipation of his arrest in connection with Jadiya P.S. Case No. 166 of 2018 registered for the offences punishable under Sections 341, 323, 379, 307, 504, 506, 34 of the Indian Penal Code and Sections 25(1-B)(a), 26 and 35 of the Arms Act.
Prosecution story disclosed that while informant was going, miscreants came on a Scorpio vehicle and fired at him but did not hit anybody. Thereafter petitioner snatched Rs.5000/- from the informant and when his father came to rescue him, he was also assaulted and one country-made pistol was recovered.
Submission of learned counsel for the petitioner is that as a matter of fact the petitioner was assaulted and one loaded pistol was recovered and for that a case has been lodged,
Patna High Court CR. MISC. No.21350 of 2019(2) dt.09-05-2019 2/2 which is Annexure-2 to this application and this false and concocted case has been filed. Further submission is that though he is accused in one more case but he is on bail in that case. Heard learned APP also.
In view of above facts and circumstances, let petitioner, in the event of arrest or surrender before the court below within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Supaul, in connection with Jadiya P.S.Case No. 166 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
