Petitioner seeks bail in a case registered for the offences punishable under Sections 420 and 506/34 of the Indian Penal Code.
Wife of the complainant has lodged Ishakchak P.S. Case No. 77 of 2017 for almost same cause of action. The petitioner was allowed bail in that case by a Coordinate Bench of this Court vide order dated 06.03.2018 passed in Cr. Misc. No. 8123 of 2018. The entire allegation is of cheating to different persons by persuading them to deposit money with the referred company.
Submission is that the company is not an accused
Patna High Court Cr.Misc. No.33235 of 2018 (2) dt.25-06-2018 2/2 in this case. The petitioner and others are said to be the office bearer of the same.
Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Complaint Case No. 08 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
