JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 02-03-2021 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in Complaint Case No. 1925 of 2017 wherein cognizance has been taken for the offences under Section 498(A) of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.

It appears that vide order dated 06.07.2020, notices were issued to O.P. No. 2/complainant but in spite of valid service of notice, she did not enter her

Patna High Court CR. MISC. No.14257 of 2020(6) dt.02-03-2021 2/3 appearance before this Court. Again vide order dated 08.01.2021, notices were issued to O.P. No. 2/complainant which were validly served to her but today also, none is appearing on behalf of O.P. No. 2/complainant which shows that she is no more interested in the matter.

The petitioner is husband of the complainant/O.P. No. 2. The allegation against the petitioner is of torture for non-fulfillment of dowry demand.

Learned counsel appearing on behalf of the petitioner would submits that the allegation against the petitioner is omnibus and general and the petitioner is ready to keep the complainant as wife with full dignity and honour.

Considering the totality of the facts and circumstances, this Court is inclined to grant anticipatory bail to the petitioner.

Let the petitioner, above named, in the event of

Patna High Court CR. MISC. No.14257 of 2020(6) dt.02-03-2021 3/3 his arrest or surrender before the Court below within a period of four weeks from today, be released on bail on anticipatory bail on his furnishing bail bonds of Rs. 50,000/-(Fifty Thousands) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Samastipur in connection with Complaint Case No. 1925 of 2017, T.R. No. 2968 of 2018.

Learned Court below, after release of the petitioner, will send the matter before the District Mediation Centre for amicable settlement of the dispute between the petitioner and the complainant/O.P. No. 2. With the aforesaid observation/direction, the application stands disposed off.
